The marriage process in Brazil can be complicated and time consuming. All individuals, regardless of nationality, who desire to be married in Brazil must comply with Brazilian law.

Wedding Enabling Process

The application for qualification for marriage will be signed by both spouses, by their own hand, or, at their request, by proxy. Must be instructed with the following documents:

· Birth certificate or equivalent document.

· Authorization in writing of the persons under whose legal dependency they are, or judicial act that supra.

· Declaration of their greatest witnesses, relatives or not, who attest to know them and affirm that there is no impediment that prevents them from marrying.

· Statements of marital status, domicile and current resistance of contractors and their parents, if known.     

· Certificate of death of the deceased spouse, of a verdict of nullity or annulment of a marriage, which is final, or of record of the divorce decree.

Those interested in marrying should seek the Civil Registry Office of the city of their domicile of one of them with the required documents.


The authorization shall be made before the Civil Registry officer and, after the hearing of the Public Prosecution Service, shall be approved by the judge.


When the documentation is in order, the official will make the announcement, which will be fixed for fifteen days in the Civil Registry of the city of both bride and groom, and will be published in the local press. In the event of urgency, the competent authority may waive publication.

Invalidity And Suspensive Causes

It is the duty of the Registrar to inform the bride and groom of the facts that may lead to the invalidity of the marriage, as well as to the various regimes of property. See topic Impediments to Marriage. Both the impediments and the suspensory causes shall be opposites in a written and signed declaration, instructed with the evidence of the alleged fact, or with the indication of the place where they can be obtained.

Opposition Note

The registry official shall give the bride and groom or their representatives an objection notice stating the grounds, evidence and name of the party submitting it. Grooms can request reasonable time to prove contrary to the facts alleged, and to promote civil and criminal actions against an opponent in bad faith.


After completing all formalities and verifying that there is no obstructive fact, the registry official will issue the certificate of habilitation. The validity of the authorization shall be ninety days from the date of the certificate. Base: Civil Code article 1,525 to 1,532.

Civil marriage

It is the marriage celebrated according to the principles of civil law.

Entitlement to marriage, registration and the first certificate shall be exempt from stamps, fees and expenses, for persons whose poverty is declared, under the penalties of the law.

Religious Marriage

Religious marriage, which meet the requirements of the law for the validity of civil marriage, equates to this, as long as recorded in the proper record, taking effect from the date of its celebration. The registration of religious marriage submits to the same requirements required for civil marriage:

The civil registry of religious marriage must be promoted within ninety days of its realization, by means of communication of the celebrant to the competent office, or at the initiative of any interested party, since it has previously homologated. After the referred deadline, registration will depend on re-habilitation.

Religious marriage concluded without the formalities required will only have civil effects if the couple's application is registered, at any time in the civil registry, upon prior authorization before the competent authority, with a period of ninety days from the date on which certificate was extracted.

The civil registry of religious marriage will be void if previously, any of the consortium members has already had another civil marriage.



There are several types of visitor visas, including tourist and business visas. You will need a Brazil tourist visa affixed to your passport while on vacation, visiting friends or family, or participating in sports, academic or artistic events or conferences for which you are unpaid – meaning anyone who is traveling for non-work purposes and won't be earning money while in the country. Visitors using a tourist visa are allowed to stay in the country for a total of 180 days in a 12-month period. Multiple entries are allowed during that period, so travelers can come and go as they please. The other types of visas are meant for students or those doing business in the country, and typically aren't right for tourists. There are several requirements for a Brazil tourist visa: (1) A passport with at least six months of validity to its expiration date, as well as two blank pages for the visa. (2) A recent passport photo. (3) A copy of a round-trip ticket (or a letter from the travel agent). (4) Proof of residency, like a utility bill or driver's license.


The Brazilian real (Portuguese: real, pl. reais; sign: R$; code: BRL) is the official currency of Brazil. It is subdivided into 100 centavos. The Central Bank of Brazil is the central bank and the issuing authority.

The climate is tropical, with a relatively cool season from May to October, and a hot and muggy season from December to March, with November and April as intermediate months. The average temperature of July is 70.5 °F, that of January and February is 81 °F. The amount of sunshine in Rio is good, but not great. In summer, the sky is often clear or partly cloudy, but some cloud banks can form, more or less intense, associated, as mentioned, with showers and thunderstorms: there are on average 7 hours of sunshine per day from January to March. In winter, the relatively dry season, there are about 6 hours of sunshine per day from June to August, and 5 in September and October. The sea is warm enough for swimming from November to May, when its temperature is equal to or higher than 75 °F, or even in June, when it drops to 73 °F; from July to October it is a bit cool, but not impossible after all, since it remains around 72 °F.
